1. TERMS AND CONDITIONS
1.1. Welcome to our website, the terms and conditions apply to the Site while using or purchasing products through our Web site - By using the Site, you represent that you confirmed to comply with these terms and conditions with us in relation to your use of the Site; This User Agreement is effective upon acceptance.
2. DEFINITIONS: -
2.1. “We” “Website” “Company” & “seller” refers to the website owner – the person to whom the order for the purchase has been given.
2.2. User/s”, “your”, “you” refers to anyone that accesses the Site.
2.3. “Buyer” “customer” refers to the person or organization placing the order.
2.4. Goods or services refers to the product(s) for which the buyer has placed an order for with the Website.
3. PRODUCTS OR SERVICES
3.1. The Company is not the manufacturer of the Products sold via the Website. Certain products or services exclusively owned by Tashqila & Marketplace Products or services owned by 3rd Party are available online through the website. These products or services may have limited quantities.
3.2. We do our best to ensure that all descriptions of products to be as accurate as possible. However, we do not warrant that product descriptions are accurate, complete, reliable, current, or error-free.
3.3. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of company. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
3.4. We do not warrant the Printing quality of Customization services (Color Print, Engrave & Hot Stamping) of any products, services, information, or other material purchased by you will meet your expectations, or that any errors in the Service will be corrected.
4. ORDER PROCESS
4.1. The website hosts a service that allows a user to select a product(s) from a list of available products, customize the product(s), make an order, and receive the order Via delivery.
4.2. The Company reserves the right to amend User submissions for all products in order to optimize its design during printing. Should there need to be a significant amendment, the order will be placed on hold and the Buyer will be notified of the issue.
4.3. The Company has made every effort to ensure that the Site accurately presents the colors and designs that the User has selected. However, we cannot guarantee that the actual colors and final look of the product will be the exact same as what the User’s phone, computer, or screen displays.
4.4. This Term also applies to the materials used in the printing process. All materials and printing are of industry standards.
4.5. The Company will not be held liable for order or delivery failures that are due to reasons outside of their control.
4.6. We are not obliged to accept your order.
4.7. We may cancel your order if we cannot supply the goods for any reason.
5. ACCURACY OF COLORS
5.1. We have made every effort to display as accurately as possible the colors or our products that appear at the website. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate.
5.2. We will have no liability (whether for damages, return of merchandise for credit, or otherwise) as a result of any variances between the appearance of colors and/or graphics displayed on your monitor and on any finished product purchased by you.
6. CUSTOMIZED CONTENT
6.1. You can add your own text, artworks, photos, images or be as creative as you like (“Customized Content”). By uploading the Customized Content for use on the custom-made products, you hereby represent, guarantee and declare that your content does not infringe any laws, regulations and any other third party’s intellectual property and any other rights.
6.2. We reserve the rights to not proceed with any content, and cancel any order, which (a) infringes or may infringe third party trademarks, copyrights, any other intellectual property or other rights; (b) is, or is suspected to be, unlawful, threatening, defamatory, libelous, obscene or could constitute or encourage conduct that would be considered a criminal offense or give rise to civil liability, or otherwise violate any law or regulation.
7. PAYMENT
7.1. We take payment from your credit or debit card & in Cash at the time we receive your order for the relevant Products, payment method (k-net – visa – Master card – Apple pay – COD) In the event that we are unable to supply the Products, we will inform you as soon as possible by email or call and refunds are made in the same manner as you made the purchase.
8. CANCELLATION
8.1. Please note that there may be certain orders that we are unable to accept and must cancel.
8.1.1. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our fraud avoidance department, we will contact you if all or any portion of your order is canceled or if additional.
8.1.2. The Company reserves the right to decline to print an order should the design conflict with the values and principles of the company. The designs that are of a political, religious, violent, abusive, or sexually explicit nature. Orders that are deemed to be in violation of this rule will be cancelled without the obligation to give a reason for the cancellation, and without any liability to the Company whatsoever.
8.1.3. Users who have their orders cancelled will be notified of the cancellation.
8.1.4. If your order is cancelled after your credit card has been charged, the said amount will be reversed back in your Account by providing us your bank details No cash disbursement shall be made under any condition whatsoever.
9. PRICING ERROR.
9.1. If an error in the price of Products was discovered, we will at its sole discretion either.
9.1.1. Inform the Customer as soon as possible and give the Customer the option of reconfirming its Order at the correct price or canceling such Order or,
9.1.2. Cancel the Order and process the refund in case the payment was already made by the Customer. The Customer acknowledges that this is the sole recourse that the Customer is entitled to in case of a pricing error.
9.1.3. We reserve the right to cancel any Order at any time before dispatching the Order.
10. SPECIAL TERMS FOR PRODUCTS SOLD BY 3RD PARTIES SELLERS ON MARKETPLACE
10.1. AVAILABILITY
10.1.1. Sellers will try to ensure that stock is available for delivery. However, sometimes, a listed item is no longer available by the time the Order is placed. If a Seller can't deliver the Order, the we will refund the Customer as per refund rules
10.2. PRICING
10.2.1. Sellers set their own prices for the Products that they sell on the Marketplace. Prices for similar or identical Products can vary from a Seller to another
10.3. Delivery of the goods will be in Next Working days applies on Marketplace Products in regular Working hours.
11. SHIPPING PROCESS & PROCEDURE
11.1. Ensuring customer satisfaction has always been our utmost priority. Our primary goal is to assure that customer shipments are delivered safely and within the allotted time interval.
11.2. Our team closely monitors all packages from dispatch until their successful delivery to customers.
11.3. We carry out timely delivery of these shipments using Our Own drivers as well as 3rd party courier services that deliver orders to customers on our behalf.
12. DELIVERY TIME:
12.1. 🚚 45 Min applies on Product owned by Tashqila in regular Working hours.
12.2. 🚚 Next Working days applies on Marketplace Products in regular Working hours.
13. GENERAL
13.1. We reserve the right to update, change or replace any part of these Terms and conditions at any time. Any such changes will be deemed to have taken effect when posted on website and it is your responsibility to check this page periodically for changes.
13.2. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the website, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
13.3. The Agreement shall be governed by and construed in accordance with the laws of the State of Kuwait. All disputes arising hereunder or in connection herewith shall be resolved amicably by discussion between the Parties, failing which the Parties shall submit the matter in dispute to be finally and exclusively settled by the competent courts of the State of Kuwait.
